KIAN PROACTIVE TERMS AND CONDITIONS 

1. Booking and Payments

  • All sessions (private, semi-private, and group) must be booked in advance through Kian Proactive’s booking system.
  • Payment for sessions is required in full at the time of booking unless otherwise arranged.
  • Kian Proactive reserves the right to review and adjust pricing. Clients will be given at least 30 days' notice of any changes to the pricing structure.
  • Session packages, once purchased, are non-refundable and non-transferable unless otherwise stated.

2. Cancellation Policy

  • Cancellations must be made at least 24 hours before the scheduled session to avoid being charged in full.
  • For cancellations made less than 24 hours in advance, the full session fee will be charged.
  • If Kian Proactive cancels or reschedules a session, clients will be notified as soon as possible, and any prepaid fees will either be credited toward a future session.

3. Session Structure

  • Private Sessions: One-on-one sessions tailored to individual fitness goals. The client must arrive on time as late arrivals will result in a shortened session, with no adjustments to the fee.
  • Semi-Private Sessions: These sessions are shared between two or three clients. All clients in a semi-private session must agree on the session time and any cancellations affect the entire group.
  • Group Sessions: Group fitness sessions are scheduled on a fixed timetable. Changes to the group session schedule will be communicated to clients in advance.

4.      Refund Policy

        Refund Eligibility:

    • Refunds will be considered on a case-by-case basis. If a client is dissatisfied with the services provided, they must submit a written request for a refund within 7 days of the session or package purchase.
    • Refunds may be offered for unused sessions in a package. Completed sessions will not be eligible for a refund.

       Conditions for Refunds:

    • Refunds will only be processed for the portion of the service that has not been used. Kian Proactive does not refund completed sessions.
    • If a session or package was booked at a discounted rate, the refund will be based on the prorated amount of the discount.

      Non-Refundable Circumstances:

    • No refunds will be issued for cancellations made less than 24 hours before a session.
    • Refunds are not available for "change of mind" or personal scheduling conflicts.

      Refund Process:

    • Upon receiving a refund request, Kian Proactive will review the situation and respond within 7 business days.
    • Approved refunds will be processed within 14 business days through the original payment method.

        Refund for Group Sessions:

         o   Group session fees are generally non-refundable. However, if Kian Proactive cancels the session and the client does not wish to reschedule, a credit will be                issued for that session to be used toward future sessions.

       Medical and Exceptional Circumstances:

    • In the case of medical reasons (e.g., illness or injury) or other exceptional circumstances, clients may be eligible for a credit for future sessions, provided that appropriate documentation (such as a medical certificate) is provided.

5. Health and Safety

  • Clients are responsible for ensuring they are in suitable health to participate in physical activity. It is advised to consult with a healthcare professional if there are any medical concerns.
  • Kian Proactive is not liable for any injury, illness, or accident that occurs during a session unless caused by negligence on the part of Kian Proactive or its staff.
  • Clients should immediately inform a trainer of any injury or discomfort experienced during a session.

6. Client Conduct

  • Clients are expected to conduct themselves respectfully toward other clients and staff. Any inappropriate or disruptive behavior may result in the suspension or termination of services.
  • Proper athletic attire, including appropriate footwear, is required during all sessions.
  • Clients are responsible for wiping down equipment after use and maintaining a clean training space.

7. Liability Waiver

  • By participating in sessions, clients acknowledge that physical exercise involves inherent risks. Kian Proactive is not responsible for any personal injury, property damage, or loss unless due to negligence by Kian Proactive.
  • Clients are responsible for securing their personal belongings during sessions. Kian Proactive is not liable for any lost or stolen items.

8. Termination of Services

  • Kian Proactive reserves the right to terminate or suspend services for any client who fails to comply with these terms or engages in harmful behavior toward staff or other clients.

9. Changes to Terms and Conditions

  • Kian Proactive may update these terms and conditions as needed. Clients will be informed of any changes via email or on the gym’s noticeboard. Clients are responsible for staying updated on the latest terms.

 

These terms and conditions are governed by the laws. Any disputes will be resolved under the applicable jurisdiction.
